Lithuanian Gaming Authority completes inspection of Top Sport

(PRESS RELEASE) -- The Lithuanian Gambling Control Authority has completed an inspection by the gambling company Top Sport regarding unauthorized advertising – the use of the betting brand in the name of the Lithuanian Football A League. During the inspection, the company eliminated the breach. Therefore, on 30 October, the PRP decided not to impose a fine or other sanctions.

With the change of the Gambling Act on 1 July, it is no longer possible to use the names of sports clubs, equals or other sponsored persons under the name of the Gambling Organizer. However, after this date, the name of Top Sport was still used in the name of Lithuanian Football A League. Thus, the LPT started an inspection of the unauthorized advertising.

At the start of the inspection, Top Sport took steps to eliminate the violation: the name of the championship began to be announced without a betting brand.

The LPT took into account Top Sport's efforts to eliminate the violation - it was no longer left before the inspection was completed. The supervisory objectives have been achieved. In accordance with the principle of minimum and proportionate supervision (implement measures are applied only where the supervisory objectives cannot be achieved in any other way, these measures must be proportionate to the nature of the infringement and the damage caused), the AVR has held that the imposition of sanctions on Top Sport is no longer appropriate.

The LPT draws attention to the fact that the use of the logos of the betting organizers in the name of the club or league is considered an advertisement that is not permissible. The law allows the betting organizer's name or trademark to be published on the stands next to the court or on the shirts of athletes. It is also allowed to inform about the sponsorship of the club or the league, for example: "football club A, which is supported by the betting company B", such a sentence without the use of logos would not be considered an advertisement.

The aim of additional restrictions on gambling advertising, which came into force on 1 July, is to reduce the availability of gambling and the harm they cause to the public. This is a transitional period before the full ban on gambling advertising takes effect.

The LPT has consistently advised on the upcoming changes. Since March, five meetings have been held with market participants and other stakeholders. In addition, 45 individual consultations were provided. Systematized information and answers to the most frequently asked questions are also published on the LPT website.

In July, after the changes came into force, the LPT continued consultations on the application of these changes in practice. After 1 July, more than 160 individual consultations were provided. If possible violations are noticed, reminders and suggestions are sent to provide more information on how to adapt to the changes.
